TERMS & CONDITIONS

INTRODUCTION

These Terms and Conditions (“Terms”) govern all reservations, stays, and use of facilities at Tému Stay, including but not limited to accommodation, outdoor amenities, activities, and services provided by the management (“Management”, “we”, “us”, or “our”).

By accessing our website, making a booking, or entering the premises, the individual or entity (“Guest”, “you”, or “your”) agrees to comply with and be bound by these Terms, which constitute a legally binding agreement.

 

Tému Stay reserves the absolute right to revise, amend, or update these Terms without prior notice. The latest version shall be published on our official website and shall take immediate effect upon posting.

RESERVATIONS AND PAYMENT POLICY

All reservations are subject to availability and written confirmation by us.


Full payment will be required at the time of booking to secure your reservation.

 

A deposit of RM 200.00 per room shall be charged upon confirmation and will be refunded within 7 working days after check-out.


Payments may be made through accepted methods including credit/debit card, bank transfer, or other payment gateways listed on the official website.


All rates are quoted in Malaysian Ringgit (MYR) and may subject to tax and levies as imposed by the Government of Malaysia.


Management reserves the right to amend rates, packages, and promotions without prior notice.


Failure to make timely payment may result in automatic cancellation of the booking without liability to the Management.

CHECK-IN AND CHECK-OUT POLICY

Check-in: 2:00 PM | Check-out: 11:00 AM


Early check-in or late check-out is subject to prior approval by the Management and may incur additional charges.


All guest information, including full names, identification numbers, and contact details, must be accurately provided at the time of booking or prior to arrival.


Guests must present valid identification upon check-in — MyKad for Malaysians or Passport for non-Malaysians.
The name and identification provided during booking must match the ID presented at check-in. In the event of any mismatch, falsified information, or impersonation, entry to the premises will be strictly prohibited and the booking may be cancelled without refund.

Any changes in guests must be informed to us prior to arrival.

The Management reserves the right to deny entry, cancel bookings, or report any suspicious or fraudulent activity to the relevant authorities.


Guests are required to notify the Management in advance if there are any changes to guest details prior to arrival.


Late check-outs beyond the stipulated time may incur additional fees or charges equivalent to an additional night’s stay.

CANCELLATION, MODIFICATION, AND REFUND POLICY

Cancellations or modifications must be submitted in writing through email or the original booking platform.

Refund Eligibility

  • 28 days or more before the arrival date: Refund 100% of the total amount of the booking, subject to processing fee.

  • Less than 28 days before the arrival date: No refund.
     

Booking Modification

  • Rescheduling booking date must notify us by email at least fourteen (14) days prior to the arrival date.

  • Rescheduling can only be done once.

  • The rescheduled date is not considered a new booking date. In the event of a cancellation or for any changes made after rescheduling, the original booking date will be used.

  • All changes are subject to current room availability, room rates and peak season charges.
     

Processing fee is 5% of the total booking amount.


Failure to check-in without prior notice will be considered a no-show, and the full booking amount will be forfeited. No refunds will be issued.


Refunds, where applicable, will be processed within 7-14 working days via the original payment method, subject to administrative fees.


The Management reserves the right to cancel or modify bookings in the event of unforeseen circumstances or Force Majeure, without liability beyond a refund or rescheduling.

GUEST OBLIGATIONS AND CONDUCT

Guests are required to conduct themselves responsibly and respectfully at all times while on the Property.


Guests must maintain cleanliness and proper care of the accommodation, furnishings, and shared facilities.


Smoking is strictly prohibited inside rooms, tents, or any enclosed area.

Possession or consumption of illegal drugs or substances is strictly prohibited and may result in immediate eviction and police involvement.


Quiet hours are enforced between 10:00 PM and 7:00 AM to ensure the comfort of all Guests.


Pets are not allowed.


Guests shall be held liable for any damage, loss, or breakage caused to Property structures, equipment, or landscape, whether accidental or intentional.


The Management reserves the right to remove any Guest who breaches these Terms or behaves in a manner deemed unsafe, unlawful, or inappropriate.

CLEANLINESS AND HYGIENE POLICY

The Management upholds strict cleanliness and hygiene standards.


All accommodations and facilities are cleaned and sanitised before each Guest’s arrival.


Guests are required to keep their accommodation areas neat and free of litter throughout their stay.


Proper disposal of waste is mandatory. Waste bins are provided at designated points, and recycling practices are encouraged.


Any spillage, damage, or unsanitary condition must be reported immediately to staff for prompt cleaning.


The Management reserves the right to impose additional cleaning or restoration charges for excessively dirty or damaged accommodation units.


The Management may access and clean rooms or camping areas during a stay if necessary for maintenance, sanitation, or safety reasons.

USE OF FACILITIES AND ACTIVITIES

All recreational and outdoor facilities, including but not limited to the sand pit, fish pool, splash pool and nature trails, are for registered Guests only.


Guests use all facilities at their own risk. Children must be supervised at all times.


Guests must comply with all safety signage, rules, and staff instructions when using facilities or participating in organised activities.


The Management shall not be held liable for any accident, injury, or property damage arising from misuse, negligence, or participation in any recreational or adventure activity.


The use of fireworks, loud sound systems, or unauthorised equipment is strictly prohibited unless approved by the Management in writing.

PROHIBITED ACTIVITIES

To protect the safety, comfort, and harmony of all Guests, the environment, and the integrity of the Property, the following activities and behaviours are strictly prohibited:

Environmental and Fire Safety Violations

  • Open burning, bonfires, or incineration of waste in undesignated areas.

  • Lighting fireworks, sky lanterns, candles, or other open flames without permission.

  • Improper handling or disposal of charcoal, gas, or flammable materials.

  • Cutting, damaging, or removing trees, plants, or natural resources.
     

Wildlife and Environmental Misconduct

  • Feeding, disturbing, capturing, or harming wildlife, stray animals, or birds.

  • Leaving food or trash outdoors, attracting wildlife.

  • Polluting or contaminating water sources, streams, or soil.

  • Fishing, hunting, or collecting natural resources without written approval.
     

Behavioural Misconduct

  • Use or possession of illegal drugs, controlled substances, or weapons.

  • Disorderly conduct, intoxication, or indecent exposure.

  • Harassment, verbal abuse, or offensive behaviour towards staff or other Guests.

  • Disrespectful, obscene, or discriminatory actions or language.

  • Excessive noise, loud music, or disruptive partying that disturbs others.

  • Engaging in violent, aggressive, or threatening behaviour.

  • Engaging in immoral or unlawful activities as defined by Malaysian law.
     

Property and Facility Misuse

  • Tampering with or damaging Property fixtures, utilities, or fire safety systems.

  • Unauthorized commercial photography, filming, or event hosting.

  • Trespassing into restricted, staff-only, or off-limits areas.

  • Theft, vandalism, or graffiti on any Property asset.
     

Other Restricted Activities

  • Cooking, grilling, or barbecuing outside designated areas.

  • Using drones, generators, or loud equipment without written consent.

  • Leaving fires, stoves, or BBQs unattended.

  • Conducting any illegal trade, solicitation, or gambling activities.

  • Picking or damaging any fruits, flowers, or plants within the premises.

  • Play or engage in any activities at the waterfall area.
     

Violations of the above may result in immediate eviction, forfeiture of payment, and/or reporting to local authorities.

The Management reserves the right to recover the cost of repairs, cleaning, or legal action for damages caused by any prohibited act.

SAFETY, SECURITY, AND LIABILITY

The safety and wellbeing of all Guests are of utmost importance. However, Guests acknowledge that outdoor activities involve inherent risks.


Guests are fully responsible for their personal safety and belongings.


The Management shall not be liable for any theft, loss, damage, or injury within the premises unless directly caused by proven gross negligence.


The Property is equipped with basic safety and surveillance measures, but absolute security cannot be guaranteed.


Guests must not engage in any form of open burning, including bonfires or waste burning, outside designated areas. Violations may result in immediate eviction and fines under local environmental regulations.

FORCE MAJEURE

The Management shall not be held liable for any failure or delay in performing its obligations caused by events beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, or power disruptions.


In such cases, the Management may offer to reschedule the stay, issue credit, or provide an alternative arrangement without liability for compensation.

PRIVACY AND DATA PROTECTION

Personal data collected during the booking process shall be used solely for reservation management, communication, and operational purposes.


Data will not be shared with third parties except as required by law or to facilitate service delivery.


Guests may contact the Management to request access to or correction of their personal data.

LIMITATION OF LIABILITY

To the fullest extent permitted by Malaysian law, Tému Stay shall not be liable for any indirect, incidental, or consequential losses, including but not limited to loss of profit, opportunity, or goodwill.


The total liability of the Management, whether in contract, tort, or otherwise, shall not exceed the total booking amount paid by the Guest.

GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Malaysia.


Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
